These Terms of Service ("Terms") govern your use of the Fibr Chrome extension and the website at tryfibr.app (collectively, the "Service"), operated by Fibr ("we", "our", "us"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

Fibr is a free Chrome browser extension that displays fabric composition information on supported fashion retailer websites. The composition data is sourced from publicly available product information published by retailers. The website at tryfibr.app provides information about the extension and related educational content about fabrics and textiles.

2. Acceptance of Terms

By installing the extension, visiting the website, or otherwise using the Service, you confirm that you are at least 13 years of age and agree to comply with these Terms. If you are using the Service on behalf of an organisation, you represent and warrant that you have authority to bind that organisation to these Terms.

3. Permitted Use

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial purposes in accordance with these Terms. You agree not to:

  • Use the Service in any way that violates applicable laws or regulations
  • Reverse-engineer, decompile, disassemble, or extract source code from the extension, except as expressly permitted by applicable law
  • Use the Service to interfere with, disrupt, or place undue burden on any retailer website, server, or third-party service
  • Redistribute, resell, sublicense, or commercially exploit the Service or its data
  • Use automated means to access the Service in a manner that exceeds reasonable personal use
  • Misrepresent your identity or affiliation when using any feature of the Service
  • Attempt to gain unauthorised access to any part of the Service or its infrastructure

4. Accuracy of Information

The fabric composition data provided by Fibr is for general informational purposes only and should not be relied upon as the sole basis for any purchasing, health, or safety decision.

While we make reasonable efforts to ensure accuracy, we do not warrant, represent, or guarantee that the data displayed is complete, current, accurate, or error-free. Composition data is sourced from publicly available retailer websites and may:

  • Be outdated if a retailer updates their product information
  • Contain errors introduced during automated data collection
  • Differ from actual product labels or physical product composition
  • Be incomplete, missing certain materials or components

You should always verify fabric composition information directly with the retailer, on the physical product label, or through other authoritative sources before making purchasing decisions — particularly if you have allergies, sensitivities, ethical concerns, or other health-related considerations regarding specific materials or fibres.

5. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. To the fullest extent permitted by applicable law, we expressly disclaim all warranties, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement
  • Any warranty that the Service will be uninterrupted, timely, error-free, secure, or free of viruses, malware, or other harmful components
  • Any warranty regarding the accuracy, reliability, completeness, or currentness of any data, content, or information provided through the Service
  • Any warranty that the Service will meet your requirements or expectations
  • Any warranty arising from course of dealing, usage of trade, or course of performance

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FIBR, ITS OWNERS, OPERATORS, DIRECTORS, EMPLOYEES, CONTRIBUTORS, AGENTS, OR AFFILIATES (COLLECTIVELY, "FIBR PARTIES") BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND, HOWEVER CAUSED, WHETHER ARISING IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, data, business, goodwill, or anticipated savings
  • Personal injury, bodily harm, allergic reactions, skin irritation, or any health issues related to fabrics, materials, or products you purchase or use after viewing data in the Service
  • Property damage of any nature arising from your use of or reliance on the Service
  • Any damages arising from reliance on fabric composition data displayed by the Service, including but not limited to incorrect, incomplete, or outdated data
  • Any purchasing decisions made based on information provided by the Service
  • Cost of procurement of substitute goods or services
  • Any interruption, suspension, or cessation of the Service
  • Any errors, inaccuracies, omissions, or defects in the data or content provided
  • Any unauthorised access to or alteration of your data or transmissions

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF THE FIBR PARTIES TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU HAVE PAID TO FIBR IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) TEN UNITED STATES DOLLARS (US $10.00).

The limitations of liability set forth above are fundamental elements of the agreement between you and Fibr. Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by applicable law.

7. Assumption of Risk

You acknowledge and agree that your use of the Service is at your sole risk. You are solely responsible for verifying the accuracy of any fabric composition data before acting on it. Fibr is an informational tool and is not a substitute for reading physical product labels, consulting retailers directly, or seeking professional advice regarding material allergies or sensitivities.

8. Indemnification

You agree to indemnify, defend, and hold harmless the Fibr Parties from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable legal fees and court costs) arising out of or related to: (a) your use of or inability to use the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any claim that your use of the Service caused damage to a third party.

9. Intellectual Property

The Fibr name, logo, extension code, website design, and original content are the property of Fibr and are protected by applicable intellectual property laws. Fabric composition data displayed by the extension is sourced from publicly available information on third-party retailer websites and remains the property of the respective retailers. Nothing in these Terms grants you any right to use the Fibr name, logo, or trademarks without prior written consent.

10. Third-Party Websites and Services

The Service operates on and interacts with third-party retailer websites to display fabric composition data. We are not affiliated with, endorsed by, sponsored by, or responsible for the content, products, services, accuracy, or practices of any third-party retailer or website. Your use of any retailer website is governed by that retailer's own terms and policies. We make no representations or warranties regarding any third-party website or its content.

11. Modification and Termination

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice, and without liability to you. We may also update these Terms from time to time. The "Last updated" date at the top of this page indicates when these Terms were last revised. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the courts of competent jurisdiction, and you consent to the personal jurisdiction of such courts.

13. Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

14. Waiver

The failure of Fibr to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Fibr.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fibr regarding your use of the Service and supersede all prior and contemporaneous agreements, proposals, representations, and understandings, whether written or oral.
